The Entrance Fencing FAQs
Councils are required to inspect pools associated with tourist and visitor accommodation and multi-occupancy developments at three-year intervals. That is different from an ordinary home, where an inspection is generally tied to sale or lease. Short-term rental accommodation and serviced apartments fall inside the tourist and visitor accommodation definition.
Multi-occupancy means a property with more than two dwellings, and those properties fall into the same three-yearly inspection cycle as tourist and visitor accommodation. The physical barrier requirements are the same ones that apply to any NSW pool.
A pool barrier in NSW must be at least 1.2 metres high measured from finished ground level. Where a boundary fence forms part of the barrier it must be at least 1.8 metres, and nothing climbable can sit within the 90 centimetre non-climbable zone.
The three common ones are a gate that no longer self-closes and self-latches from any open position, furniture or pots left inside the 90 centimetre non-climbable zone, and planting that has grown into it. Replacing a tired barrier outright is usually a glass pool fencing or aluminium pool fencing job. On a let property those tend to appear between inspections rather than at handover, so they are worth checking before the inspector does.
